These Terms govern access to and use of Evalynx. By using the platform, you agree to these Terms.
1. Scope of Service
Evalynx provides assessment delivery, exam administration, proctoring (when enabled), analytics, and related reporting tools for tenant organizations.
2. Acceptable Use
- Use Evalynx only for authorized exam and assessment operations.
- Do not attempt to bypass controls, exploit vulnerabilities, or interfere with platform operations.
- Do not submit unlawful, abusive, or malicious content through the service.
3. Accounts and Credentials
- Users are responsible for safeguarding login credentials.
- Account actions are attributable to authenticated sessions tied to that account.
- Unauthorized access attempts may lead to suspension or revocation.
4. Assessment Integrity and Proctoring
- Exam sessions, submissions, and proctoring events may be reviewed for policy compliance.
- Integrity violations can result in warning flags, invalidation, or restricted access as per tenant policy.
5. Tenant Responsibilities
- Tenant administrators are responsible for lawful exam configuration and user access control.
- Tenants are responsible for candidate communications, policy disclosures, and compliance requirements applicable to their jurisdiction.
6. Billing and Subscription
Where paid plans apply, billing, plan limits, and entitlements are governed by configured subscription settings and payment gateway confirmations.
7. Availability and Maintenance
We aim for reliable service operation, but uninterrupted uptime is not guaranteed. Planned maintenance, security interventions, or force majeure events may affect availability.
8. Intellectual Property
Evalynx software, branding, and associated materials remain the property of their respective owners. Tenant-owned exam content remains under tenant control, subject to service operation requirements.
9. Limitation of Liability
To the maximum extent permitted by law, Evalynx is provided on an "as is" and "as available" basis without warranties of uninterrupted operation for every deployment environment.
10. Termination
Access may be suspended or terminated for material breach, abuse, legal risk, or security incidents.
11. Changes to Terms
We may update these Terms from time to time. Continued use after updates constitutes acceptance of the revised Terms.
